The terminal, developed by Contented Kiosks, allows customers to transfer money into e-cash to spend on a range of online services including gaming using an off-shore site. The Gaming Board's Cliff Young said "I can confirm that we have met with the owner of the premises where the machine is sited along with a representative of the supplier and their legal representative. Following discussions of the latter's legal opinion the Board is of the view that the operation of this machine involves the organising and management of gaming and that gaming is taking place on the premises. Therefore the Board is of the view that the continued operation of the machine involves offences under the 1968 Gaming Act. Contented Kiosks' legal adviser, Kevin de Haan, is of the opinion that the internet kiosk is not a gaming machine under the 1968 Act and argues that under the DCMS's own stated position that internet gaming happens at the server level and not where the customers sit, which the company contends comprehensively removes all internet gaming from the jurisdiction of the Gaming Board.
